| 摘 要： | 当前刑法学界中的关于紧急避险的观点涵盖的都是一般情况下的一般紧急避险。遵循从一般到特殊的逻辑规律,特殊紧急避险关键在于其不同于一般紧急避险的特殊之处。这一特殊之处主要表现为两个特殊———特殊的避险情况和特殊的避险方式。如此,特殊紧急避险在定义、法理依据和成立条件等方面均有其不同于一般紧急避险的特殊之处。既要照顾一般又要抓住重点(特殊),全面研究问题是辩证唯物论的观点。研究特殊紧急避险,无论对理论界还是实务界来说,无疑都有着重大的意义。

| Abstract: | The previous perspectives concerning emergency avoidance in the field of criminal laws are mainly confined to general manners in general situations.While special emergency avoidance,obeying the regularity-from generalization to specialization,differs them in its special situations and special manners in dealing with avoiding sudden dangerous cases.This paper,exploring special emergency avoidance from the perspective of its definition,jurisprudence and conditions,offers a comparatively thorough research,which is of great importance to either the theoretical world or the practical world. |
