| 摘 要： | 关于我国<合同法>中规定的物之瑕疵担保责任与违约责任的关系问题,在我国学者之间存在着不同的主张.分析表明,所谓的"相对独立说"或"独立说",在我国的制度背景下没有实质性的意义,物之瑕疵担保责任也没有"相对独立"的必要性.结合这一观点,在论证中指出我国<合同法>相关规定在体系和移植方面存在着的不合理性.
