| 摘 要： | 市场经济下交易者往往通过契约来协助完成交易,而契约的实现需要一套完善的保障制度.借助文献资料,本文系统分析了职业体育市场契约的保障制度,基本结论是:1)契约的激励制度是解决职业体育外部性的有效制度,具体做法是拉大胜负者的收益差距;2)监督体系包括联盟总裁监督、裁判监督和媒体监督三个层次;3)体育争议的解决包括调解和仲裁两个体系;4)契约的担保制度包括事前担保和事后担保两种.事前担保是通过人和物资的事先投入来实现的,事后担保则包括各种保险制度.

| Abstract: | The dealers usually conclude a transaction through contract in market - oriented economics ,whereas a successful contract needs a set of well - established guarantee mechanism. By literature study , the guarantee system in the professional sports market contract was analyzed. Incentive system was shown to be the effective system to solve the external feature of professional sports. Supervision included league president supervision , referee supervision and media supervision. The solution of sports conflicts included mediation and arbitration. The guarantee system of contract included beforehand guarantee by investment of personnel and material in advance and behindhand guarantee by insurance systems. |
