| 摘 要： | 盗赃的善意占有问题是一个现实性很强的问题。它是否适用善意取得制度，它与善意取得制度究竟是怎样的关系?这些问题在我国无论是理论界还是司法实践中。都存在着不同的观点。从善意取得制度的功能入手，通过对盗赃善意占有性质分析，通过与国外对同一问题规定的比较，可以揭示我国关于盗赃善意占有制度的不足。

| Abstract: | To hold stolen goods in good faith is a very realistic problem. Does it suit the system of holding in good faith? What kind of relationship between it and the system of holding in good faith? There are different viewpoints on these problems in our country in the fields of both theory and practice. This essay begins with the function of the system of holding in good faith through discussing the nature of holding in good faith and comparing with the rules on the same problem in foreign countries. This essay can also show the shortcomings on the system of holding in good faith in our country. |
