| 摘 要： | 自法产生至今,习惯法一直占据着重要地位。人类社会产生之初,习惯法的萌芽就已经出现,随着人类社会的发展,习惯法也不断的发展完善。在当今社会,习惯法仍然发挥着重要作用,必须厘清习惯法与制定法的关系,习惯法与制定法在社会生活中所处的位置与作用。习惯法与制定法之间存在冲突是不可避免的,当习惯法与制定法发生冲突时,要结合具体情况具体分析,必要时习惯法应当居于首要地位,优先于制定法的适用。

| Abstract: | As an important component of law, from the day law is produced, customary law has occupied an important position. Emerged as early as the beginning of human society, it is continuing to improve alongside the developments of the human society. In today＇s society, it is still no less important. To analyze the customary law, we must clarify the relationship between customary law and statutory law, the position of the customary law and statutory law in the social life. The conflict between customary law and statutory law is inevitable. So when conflict occurs, we should analyze specific circumstances. If necessary, customary law should take up the primary position, taking precedence over statutory law. |
