| 摘 要： | 目前，我国已初步形成了比较完整的商标法律保护体系，但对商号特别是驰名商号的保护立法却严重滞后。通过对我国驰名商号保护立法现状及其必要性的分析，提出我国应采取驰名商号主动认定为主，被动认定为辅的原则，将驰名商标的扩大保护原则延伸至驰名商号，对驰名商号实施跨地域、跨行业的特别保护，健全保护措施。
