| 摘 要： | 我国《民法通则》在物权法框架下设计的农用地使用权在实践中并非物权性质，而是债权性质。我国现行的农用地使用权在流转中具有流转客体的单一性，流转范围的封闭性和流转方式的债权性，对维护农民的生产积极性、农用地的市场性流转、农用地使用权制度的稳定和维护土地承包经营的合法权益都极为不利。要切实保护农用使用权，必须依物权法规则对农用使用权的法律保护进行重新构建。

| Abstract: | The artile discusses the concept of farming land's right to use and expounds that the farming land's right to use is not the character of real right,but the character of obligatory right under the frame of real right law in the Civil L aw when it is at practice.The article also considers thatthe active farming land's right to use has the oneness of object,the close range and the character of obligatory right when itis on the move. It is very disadvantageous to protect the peasants productive enthusiasm,the market circulation of farming land,the stability of farming land's right of use system,the legal right of land contractor.if we want to protect the farming land's right to use pressingly,we should reconstructive the legal protection of farming land's right to use by the rule of real right law, |
