| 摘 要： | 法律近代化离不开法律名词的近代化。中国法律新名词源于西方,而取法于东邻日本。先进的中国人在取法日本的过程中,留下了许多不朽的篇章,其中以黄遵宪的《日本国志》行文最早,影响最大。《日本国志》内存有大量近代西方法律新名词,近代中国人通过学习它,迅速地掌握了西方近代法律术语,从而大大加快了中国法律的近代化。《日本国志》实为中国法律近代化的一块巨石,黄遵宪实为中国法律近代化的先驱。

| Abstract: | When we talk about the modernization of Chinese statue,we must say the modernization of law terms.The new terms of Chinese statue came from the west,and follow the example of Japan in the east.Advanced Chinese had left a lot of immortal chapters during the process of following the example of Japan.Among these Japan's Annals written by Huang Zunxian appeared earliest and affected greatest.There are a large number of modern western legal new terms in the memory of Japan's Annals.Modern Chinese studied it swiftly and mastered westerly modern law terminology.So it speed up the modernization of Chinese statue hugely.Real a huge stone that took in modern times for Chinese statue of Japan's Annals,the real pioneer that took in modern times for Chinese statue of Huang Zunxian. |
