| 摘 要： | 盗窃电能犯罪属于盗窃罪，是不纯正数额犯，盗窃电能数额在定罪和量刑中都具有至关重要的作用，准确认定盗窃电能数额是正确定罪量刑的基础。通过对实践中盗窃电能犯罪数额认定的现状可知，刑事法律应按照客观真实原则、公平公正原则、存疑有利被告人原则确定盗窃电能犯罪数额的认定方法，以利于司法操作。

| Abstract: | It is the larceny to steal the electric energy.But it is not a pure amount crime.The amount in the crime of stealing the electric energy has essential function in declaring guilty and measurement of penalty.And authenticating the amount of power accurately is the foundation of confirming the measurement of penalty of stealing electric energy.Through the current situation of authenticating the number in the crime of stealing the electric energy in practice we can know that Criminal Law should be in accordance with the principles of objective truth,fair and just principles,the principle of doubt beneficial to the accused criminal while authenticating the amount of power theft in that way,so as to help the administration of justice to operate. |
