| 摘 要： | 所谓侵犯商业秘密罪 ,是指行为人以盗窃、利诱、胁迫或其他不正当手段侵犯他人的商业秘密 ,给商业秘密人造成重大损失的行为。该罪是否成立 ,应从其构成特征进行分析 ,同时要在司法实务中划清本罪与假冒专利罪、非法获取国家秘密罪的界限。

| Abstract: | The criminal of transgressing against the law of business secrecy indicates that the person infringes the business secrecy of others' by robbing and temfting,menacing and other unfair methods,making great loss to the oblige that owns the business secrecy.Whether the criminal of transgressing business secrecy exists or not,we should make analyses from its constructive character,distiguishing it from the criminal of counterfeiting patent and unlawfully obtaining national secrecy. |
