| 摘 要： | 探望权是我国新《婚姻法》确立的一项新制度，它有利于保障未成年人的健康成长，有利于维护婚姻当事人的正当权利，有利于促进和谐家庭的建设。探望权是一种法定的身份权，具有法定性、身份性、时间性、双向性和义务性的特点。立法应扩大探望权的权利人范围，完善探望权的行使和实现机制。

| Abstract: | Visitation rights is a newly established system in the Marriage Law. It is beneficial to ensure the healthy growing-up juveniles, to defend the marriage party＇s legitimate rights, and to construct the harmonious family. Visitation tights is one kind of legal dignity rights, beating features of legality, identity timeliness, bidirectional capability and voluntariness. This article proposes that the range of the obligee should be expanded and the exercising and realizing mechanism should be perfected. |
