| 摘 要： | 我国对于环境犯罪采取的处罚方法包括自由刑和罚金刑两种,罚金刑因与环境犯罪的特殊性相契合而更加有利于实现环境刑法的初衷.但我国环境犯罪中罚金刑的适用还存在诸多明显缺陷,如适用范围狭窄、适用方式不当、数额不确定等,应当从扩大罚金刑适用范围、完善罚金刑适用方式、缩小环境犯罪的罚金刑幅度、增强罚金刑对不断变化的经济和环境形势的适应力等方面完善其适用.
