| 摘 要： | 在自由主义传统中,公民资格意味着一系列的权利以及对权利的获得和占有,在个体和共同体的关系上,强调个体性对于共同体之先在性,主张个体不应受共同体过多的限制,公民资格意味着一种法律地位以及法律上对权利的消极保护,公民特征体现为消极公民和消极自由。古典自由主义的这种公民资格观念尽管在学理上承诺了自由和平等,然而却无法在实践上兑现,不可避免地造成原子式的个人以及对共同体价值的忽视。

| Abstract: | In the tradition of the liberalism,citizenship means a set of rights and the gain of the rights.On the realation of the individual and community,liberalism insists on the priority of the individuality,and they claim that community shoudn't impose too much restrict on the individual.Citizenship means a kind of legal state and a kind of negative protect come from law.The citizen is a kind of passive citizen,and the freedom is a kind of negative freedom.Though the ideal of the classic liberalism citizenship gives the doctrinal promises about freedom and equality,they couldn't realize it in the practice.This kind of citizenship inevitably results in atom individual and neglects the value of the community. |
