| 摘 要： | 环境保护与贸易自由已经成为世界潮流，二者交汇必然产生冲突。WTO在环境与贸易的关系上已陷入立法困境，但其争端解决机制通过对争端的裁决，对环境与贸易的冲突进行了司法性阐述，由于争端解决机制之局限性及环境与贸易关系之特殊性导致效果不尽人意，改革势在必然。

| Abstract: | Environmental protection and freedom of trade become world trends,which might collide with each other.WTO has already got into the legislative predicament on the relation between environment and trade.The disputes settlement mechanism has carried on judicial exposition on the conflict of environment and trade.Due to the limitation of the mechanism itself and particularity of the relation of environment and trade,reform is inevitable. |
