| 摘 要： | 逻辑是律师法律推理的重要工具,逻辑性是律师法律推理的主要特征,这与法律的逻辑性有关,也与司法过程的说理性、证立性有关。法律适用需要得到必然的结论,因此,对于法律推理来说,演绎推理的"必然地得出"特征满足了这一要求。

| Abstract: | Logic is an important instrument for lawyers in their inferences,in which logicality is the major feature.This feature comes mainly from the logicality of laws and the reasonability and proof establishment in judicatory process.Laws applicable in a case need to lead to an inevitable conclusion.In legal process of deriving logical conclusions,deductive inference meets the needs of 'inevitability'. |
