| 摘 要： | 机动车普及的过程就是机动车事故受害人保护问题凸显的过程,同时也是机动车事故责任严格化和保险强制化的过程。严格责任是比过错责任更为严格的不同责任形态的汇集,其正当性理由并不相同。不同国家立法的发展已经表明机动车事故领域最适合课予严格责任,而危险、受害人保护及风险分散等是其正当性基础。《道路交通安全法》“撞了不白撞”规定的合理性争论应当考虑机动车保有人对责任保险的可得性因素。

| Abstract: | The process that the motor vehicle is popularized is the process of highlighting the problems of protection of motor vehicle accident victims.Meanwhile it is the process of tightening the liability for motor vehicle and the compulsion of insurance.Strict liability is the gathering of different strict liabilities other than fault liability,but its warrant is not the same.The law development of different countries has indicated that it is most suitable to stipulate the strict liability in the field of motor vehicle accident,and danger,the victim protection,and dispersion of risks are its proper foundation.The debates on rationality of"hits not free of charge"stipulated in"Road Traffic Safety law "should consider the acquirability of liability insurance of motor vehicles owner. |
