| 摘 要： | 目的/意义]情报工作涉及国家权力的使用。对情报工作的监督是国家权力使用规范化、法治化的重要表现。英国和美国在实现情报工作专业化和现代化的过程中,也十分重视情报监督工作。英国和美国情报监督体系逐渐完善,积累了比较丰富的经验。深入研究英美情报监督体系对我国情报理论和实务都具有明显的借鉴意义。方法/过程]在研究过程中,主要运用定性分析方法,对英美国家情报监督的体系和特点,以及存在的问题及原因进行了论证,结合中国情报监督存在的问题,提出了对我国未来情报监督工作的建设思路。结果/结论]该文建议结合中国情报工作的实践,以总体国家安全观为指导,加强党对情报监督工作的领导,明确情报监督的主体,以立法为手段规范情报监督的内容,构建情报监督体系。

| Abstract: | Purpose/Significance]Intelligence involves the use of the state power.The oversight of intelligence is needed for the rule of law,which guides the use of the state power.The U.K.and the U.S.both have a long history of intelligence,and have a sound intelligence oversight mechanism.The research on intelligence oversight mechanism has important theoretical and practical significance for guiding the intelligence development in China.Method/Process]This research mainly uses qualitative analysis method in analyzing the types,mechanisms,contents and characteristics of intelligence oversight in the U.K.and the U.S.,analyzes their problems and causes,and finally studies the implications.The main objects of the research include the organization of the intelligence oversight mechanism,legislation,budget,and protection of privacy.Result/Conclusion]This paper proposes policy recommendations for the development of intelligence oversight in China such as advocating the concept of the holistic approach of national security,strengthening the leadership of the Party in the intelligence work,defining the intelligence oversight by the law,and balancing the need for national security and the protection of individual privacy. |
