| 摘 要： | BOT投资方式与其它投资方式不同，具有主体的特殊性、内容的复杂性以及客体的特定性等法律特征。该投资方式自20世纪80年代中期开始在我国运用，实践中对现行立法多有突破，相关法规规范间也存在冲突。“十一五”期间，必须完善BOT投资立法，创造良好的投资环境。

| Abstract: | BOT investment is different from general foreign investment,with its legal subject being particular,its content being complex and its object being specific.BOT investment started from 1980's in China.In the practice,it has many breakthroughs against the present legislation,and produces conflicts between laws and regulations.During the 11th Five-year Plan period,we must perfect BOT investment legislation,creating a good investment environment. |
