| 摘 要： | 在信用证支付方式中,严格执行信用证独立于基础合约的原则有重要意义,但面对日益严重的单证欺诈,法院是不能妄顾买方利益而固守这一原则的,为弥补这一缺陷,各国司法实践都在承认信用证独立了买卖合约的同时,也承认有例外的情况。

| Abstract: | When the payment is made through L/C,it is essential to strictly implement the principle of the L/C's independence from contracts.But nowadays confronted with the increasing number of document fraud,the court is not able to stick to this principle without considering the buyers benefits.To remedy this disfigurement,besides the L/C's independence from contracts,the exception principle also can be applied to judicial practice. |
