| 摘 要： | 随着经济的发展,我国保险业出现一个新的险种——保证保险。由于保证保险表现出两种法律关系:保证法律关系和保险法律关系,对于保证保险的法律性质,法学理论界存在着较大的分歧。通过从保证保险的表现形式和内在实质两方面对其法律性质进行剖析,得出保证保险的法律性质应为保证。

| Abstract: | With the economic development emerged a new type of insurance——guarantee insurance in China,which contains the legal relationship of guarantee and that of insurance.There is a big divergence concerning the legal nature of guarantee insurance in China's legal theory society.The article mainly analyzes the legal nature of guarantee insurance by discussing its forms and essence,and thus arrives at the conclusion that guarantee should be the legal nature of guarantee insurance. |
