| 摘 要： | 对施工合同进行行政监管,加强了《合同法》维护市场交易的力度,可以合理调节甲乙双方的权利义务关系,平衡当事人之间的合同权益,从而将维护合同自由和合同正义结合起来,使合同当事人依法行事,杜绝违法乱纪、损害社会的现象发生,确保建筑市场的规范、健康发展。同时,还可以规范建设各方的履约行为,保证施工合同的顺利履行,使工程能够及早发挥经济效益和社会效益。在现阶段,加强施工合同的行政监管很有必要。

| Abstract: | Administrative supervision toward construction contract can reinforce the vigor of contract law which protects market dealing,properly adjust rights and obligation between both parties,balance contract interests among parties in order to uphold the freedom and justness of contract,so the parties can act according to law,incidents which violate the law,discipline and society can be banned.Building market can develop standardly and soundly.Meanwhile,regulation of the fullfillment conduct of building parties,construction contract carried out smoothly and playing socioeconomic performance at the earliest possible time assure the treatment of various problems and disputes in the process of building programme.At present,it is necessary to enforce adminstrative supervision toward construction contract. |
