| 摘 要： | 刑法司法解释是指享有解释权的最高人民法院、最高人民检察院在刑事实体法的适用过程中,对各级司法机关均应遵照执行的刑事法律规范的内涵和适用范围所作的一种直接阐释,从而揭示刑事法律规范所体现的立法者的意图和要求,保证刑法得到准确的适用。就性质而言,它虽是一种创制规则的活动,但须以不违背刑事法律立法本意为原则。尽管如此,由于刑事司法解释是刑法在实际适用中的具体化,也是司法机关适用法律过程中加以引用的重要依据,并为公众所熟知,因而能否全面准确的适用事关行为人的切身利益,因此对刑法司法解释的研究具有重要的理论和现实意义。

| Abstract: | The criminal law judicial interpretation is refers enjoys the explanation power Supreme People's Court,the Supreme People's Procuratorate in the criminal substantive law suitable process,should obey one kind of direct explanation to all levels of judicial organ which the execution the criminal law standard connotation and the applicable scope do,thus the revelation criminal activity law standard manifests legislator's intention and the request,guaranteed the criminal law obtains accurate being suitable.Speaking of the nature,although it is one kind formulates the rule the activity,only want take does not violate the criminal law legislation original intention as the principle.For all this,because the criminal activity judicial interpretation is the criminal law is suitable in the reality the concrete application,also is the judicial organ is suitable the important basis which in the legal process performs to quote,and knew very well for the public,thus whether comprehensive accurate suitable critical time author's vital interest,therefore has the important theory and the practical significance to the criminal law judicial interpretation research. |
