| 摘 要： | 在科学发展观指引下，改革、完善现行土地承包经营权流转机制已经刻不容缓。宏观上，借鉴国资委与国企管理层的运作机制，在现有法律基本构架内，将所有权与经营权分离，村委会与村经济合作社分设，各司其职，改进治理结构，强化监督；微观上，规范“乡里中间层”权力、完善承包土地流转制度、构建多元化纠纷解决机制。通过制度建设，最终实现土地承包经营权合法、有序流转之目的。
