| 摘 要： | 传统观点认为作品是作者人格的反映,因此著作人身权不可转让,此观点与网络功能相冲突。文章在考察法哲学思潮演进的基础上,通过介绍各国有关著作人身权转让的最新立法动向,应映网络时代的要求,主张著作人身权可转让。

| Abstract: | traditionally, personal right on copyright can not be assigned, for the works can mirror authors' personality, which contradict the function of cyberspace. Based on the evolution of thoughts on law philosophy, the paper introduces the latest law about the assignment of personal right on copyright in some countries to reflect the demand for era of cyberspace, and advocates that personal right on copyright should be assigned. |
