| 摘 要： | 在全面推进依法治国的背景下,对政府购买教育服务进行法治化,首先要确保政府购买教育服务在法律范围内展开,这是政府购买教育服务法治化的根本准则;其次要确保通过立法、司法及公民权利等法治手段控制政府购买教育服务权,这是政府购买教育服务法治化的治本之策;最后要确保对政府购买教育服务活动中的违法主体实施民事、行政和刑事制裁,这是政府购买教育服务法治化的内在要求。由此构架了政府购买教育服务法治化的基础内容。

| Abstract: | Under the historical background of comprehensively advancing law-based governance of China in the new era, the legalization of the government purchase of education services should firstly ensure that the government purchase is conducted within the law, which is the fundamental rule for the legalization of the government purchase of education services. Secondly, it is necessary to ensure that the government power to purchase education services is controlled through legislation, justice and civil rights, which is a fundamental solution to the legalization of the government purchase of education services. Finally, it is necessary to ensure the implementation of civil, administrative and criminal sanction measures against illegal subjects in the government purchase of education services, which is an inherent requirement for the legalization of the government purchase of education services. The three aspects mentioned above combine to constitute the basic content of the legalization of the government purchase of education services. |
