| 摘 要： | 权利瑕疵担保责任是大陆法传统的瑕疵担保责任之一,其有特定的理论基础;它是一种特殊的债务不履行责任,其构成要件及效力有其自身的特点;在标的物的所有权属于第三人的场合,权利瑕疵担保责任的适用颇为困难,尚需对责任的主观构成要件进行修正.

| Abstract: | Warranty against defects of title is one of the traditional warranties against defects in continental law system,and has a specific basis in theory.It is a kind of special liability of breach and has unique trait in its constituent elements and legal force.When the article is owned by the third party,it is very difficult to apply warranty against defects of title,and then it is necessary to revise the subjective constituent elements of warranty against defects of title. |
