| 摘 要： | 罗瞻顾西方比较法方法论研究发展史，比较法研究先后形成规范比较范式、功能比较范式、文化比较范式。三大范式各有优缺，我国在借鉴西方比较法方法论时理应摘瑕指瑜，理揉各范式优长寻得一条适合中国实践语境的研究范式。

| Abstract: | According to the development of researches on the western comparison methodology,comparison methodology can be divided into three paradigms which are the paradigm of norm comparison,the paradigm of function comparison and the paradigm of culture comparison.Since the three paradigms all have their advantages and disadvantages, a certain paradigm should be chosen to be suitable for the Chinese context by making full use of their advantages and getting rid of their disadvantages. |
