| 摘 要： | 中国古代的成文法起自军法。其长处是公平、公开和确定不移,其短处是过于苛暴。优缺点出自一源,即战争环境的需要。儒家引礼入法的目的在于矫秦之失,但由于设置双重标准,最终必然会走上以礼代法和以礼坏法的道路,从而使中国古代始终处在有法律而无法治的人治阶段。要建设法治社会,必须以开放的心态学习世界各国的成功经验。过分夸大引礼入法的作用和意义,曲折表达了对法律等级性的肯定。人人都承认法治优于人治,但人人都不愿自觉接受法律的约束,并对司法特权充满依恋,是中国法治建设所面临的最大难题。
