| 摘 要： | 依申请公开政府信息制度在运行中不应限制申请人的范围,外国人、外国法人或其他组织也应当根据国民待遇原则享有申请信息公开权利,只是在获取信息的方式和内容上加以限制,以保护我国的国家机密和商业秘密。申请人的理由也不应做严格限制,行政机关可以询问申请人的理由,但是无须进行认定。实践中,行政相对人滥用申请、多次连续申请、申请信息公开的收费方式以及行政机关的服务方式等是受理申请公开政府信息经常遇到的难题,须在解决问题的过程中对政府信息公开制度加以修订和完善。

| Abstract: | In the operation of the openness of government information by application,the identities of the applicants should not be restricted.Foreigners,foreign legal corporations or the other organizations can enjoy the right to apply for government information opening.Besides,the reasons for application for the information openness should not be restricted,either.The author suggests that regulations of government information openness should be revised and improved so as to deal with the problems in hearing the cases of government information openness,such as the abuse of application of the administrative counterpart,consecutive application,fees and service ways of administrative organs and so on. |
