| 摘 要： | 刑事被害人国家补偿制度体现了以人为本、公平正义、安定有序等价值理念，与社会主义和谐社会的构建正相契合。重刑轻民思想、资金供给的有限、实际操作的困难等因素制约我国刑事被害人国家补偿制度的构建，只有针对以上因素进行破解，才能尽快建立适合我国国情的刑事被害人国家补偿制度。

| Abstract: | The national compensation system for criminal victims embodies the value of the people - oriented, fairness and jus- tice, stability and order, which is conformity with the construction of socialist harmonious society. Emphasizing the role of the crimi- nal law instead of the civil law, short of funds , problems in practical operation have restricted the development of compensation sys- tem for criminal victims . Only those problems are resolved, can we establish the criminal victim national compensation system suit- able for the situation of our country. |
