| 摘 要： | 通过评述国内外普通高校与学生之间的法律关系理论,认为二者公法上存有特别权力关系、外部行政法律关系,私法上有民事法律关系以及教育契约关系。不同的法律关系决定不同的学生权利救济制度。根据高校特殊的法律地位以及与学生的不同法律关系,应该建立一套完善的权利救济制度,互相衔接配合,最终达到维护高校教育性必需的自主性管理权与保护学生合法权利的目的。

| Abstract: | By analyzing the theories about the law relationship between universities and their students of China and abroad,this paper considers that universities and their students have a special power relationship and an external administrative relationship according to public laws,and the two sides also have a civil legal relationship and an education contract relationship according to private laws.Since legal relationships are different,student rights relief systems are different from each other.According to universities' special legal positions and their different legal relationships with students,an ideal student right relief system should be established so as to protect both the autonomous administration power of universities and the legal rights of their students. |
