| 摘 要： | 利用影响力受贿罪是刑法修正案(七)中新设立的罪名,即把非国家工作人员利用国家工作人员的职权、地位或者其他影响,通过其他国家工作人员的职权行为,索取或者收受他人财物,为他人谋取不正当利益的严重行为定为犯罪。本罪的设立体现了刑法的与时俱进,弥补了现有受贿犯罪立法的缺陷,有利于完善我国的刑事法网,同时也有利于与国际刑法接轨,但在本罪的认定过程中仍应严格把握两个问题,即本罪与受贿罪的界限问题,关于共犯的问题,以期对本罪有更深入的理解和更准确的定性。

| Abstract: | The crime of bribery from use of influencing power is newly established in the Criminal Law Amendment（seven）,that is,the serious acts that the non-national staff take advantages of their power,status or other effects of national staff to ask for or accept property from others,or to seek illegitimate interests for others by other terms of staff′s behavior are defined as committing crime.The establishment of this crime reflects that criminal law develops with the time,which is conducive to improve China′s law of criminal,to make up for the deficiencies in the existing legislation of crime of bribery,and is conducive to integrate with the international criminal law.But in the process of recognition of this crime two issues should be strictly controlled,namely boundary issues of the crime and Crimes of Bribery.On the issue of Joint Crimes,there should be a deeper understanding and more accurate characterization to the crime. |
