| 摘 要： | 专利制度是社会经济发展到一定历史阶段后制度创新的产物，它是一种旨在保护创新成果以促进经济发展和科技进步的法律制度。通过考察美国专利法的产生和发展，阐明现代专利制度发展中的一些基本特征与规律，为中国建立更加完善的、符合社会发展需要的专利制度体系提供一个较为完整的参照系。

| Abstract: | Patent institution is the result of institutional innovation after the development of social economy to certain historical stage, and it is a legal system that aims to protect the innovation achievement for promoting the development of economy and science ＆ technology. Through surveying the principle of the balance of interests and the evolution course of American patent institution, this dissertation summarizes some basic characters and laws in the developing course of modern patent system, providing a more complete reference system for our country establishing a more perfect and suitable patent institution. |
