| 摘 要： | 归责原则是处理体育伤害事故的核心问题,是解决事故的关键所在。本文运用文献资料法、逻辑分析法,立足于我国民事法基本归责原则,在过错责任原则、无过错责任原则和公平责任原则的基础上,探讨我国体育伤害事故归责原则的适用。通过分析认为体育伤害事故归责原则可适用以＂风险自负＂理论作为免责事由的过错责任原则和公平责任原则。

| Abstract: | Imputation rules (IR) is the core problem in which deal with sport injury accidents (SIA) and is also solution key in SIA.This paper,adopted the methods of literature and logic,analyzes the adaptation of IR of SIA in China.The argumentation in this paper based on IR of civil law,liability for fault,liability without fault and fair liability principle.It can be draw a conclusion that the IR of SIA can use the theory of At One's Own Risk as liability for fault and fair liability principle of exemption reason. |
