| 摘 要： | 由于域名具有类似于商标的识别作用，并常作为商标在网络上的替代标识出现，因此域名的争议常常牵涉到对商标权的保护问题。通过两起域名争议案件的裁决的比较，对域名与商标冲突过程中的法律依据进行分析，寻找域名争议与商标冲突过程中利益衡量的因素。

| Abstract: | As domain names are as similar as trademarks in function and sometimes represent trademarks in the internet,the settlement of the domain names disputes is usually related to the protection of trademark right.Through the comparison of the arbitrations in two different domain name disputes,the author analyzes the legal basis and foundation in an attempt to weigh the interest factors in the conflicts between domain names and trademarks. |
