| 摘 要： | 物权法将国家所有权纳入调整范畴,但实践中并未对其进行清晰的权能划定。从公权力介入市民社会的发展史来看,国家所有权具有部分私法性质,能够被纳入物权法。但国家所有权应当采大陆法系的双重结构模式进行重构。

| Abstract: | Property Law has covered state ownership in literature,but failed to set legal extent of powers of this system.From the process of the public power's intervention into civil society,it is believed that state ownership has features of private ownership,which allows its adoption in Property Law.However,state ownership should be restructured according to the dual structure theory in civil law system. |
