| 摘 要： | 彩礼返还问题一直是理论界较难定论、实务界较难操作的问题。一方面是缺乏具体可操作的法律规范；另一方面是对该问题的理论认识尚未取得共识。《最高人民法院关于适用（中华人民共和国婚姻法〉若干问题的解释（二）》虽然对彩礼返还问题作出规定，但规定过于简略，远远满足不了现实生活需要。因此，面对这个普遍性的法律问题，在司法实践中总是容易出现不同的裁决情况。文章通过对彩礼内涵的界定及其性质的探讨，分析目前彩礼返还制度存在的缺陷，并提出完善相关制度的建议，以期能对现行操作有所推动。

| Abstract: | The return of betrothal gifts is always a difficult phrase in theory, and also difficult to operate in practice.One is the lack of legal norms of practical~ On the other hand, the theory has not reached unified conclusion. Interpretation of the Supreme People ＇s Court on some issues concerns the application of ＂The Marriage Law of the People＇s Republic of China＂（two）,Although the law has the provisions of the return of betrothal gifts, but the provisions are too simple,far from the needs of the real life.Therefore ,in the face of the universality of the legal problems judicial practice is always prone to award different judgements.This paper discusses the definition of betrothal gifts and the nature of its current system defects, proposes to improve the relevant system, in order to promote the current operation. |
