| 摘 要： | 提单在国际贸易和航运中充当承运人收受货物的证据，又是运输合同的证明以及承运人交付货物的惟一凭证。因此，从理论上和立法规定上界定清楚提单的性质非常必要。本文试图对这一问题进行分析．以明确并非所有的提单均为物权凭证，而有些为物权凭证的提单也并非所有权凭证。

| Abstract: | A bills of lading is regarded as the certificate of carrier's receiving goods, and the proof of transport contract and the only certificate of carrier's delivering goods in international trade and shipping. So it is very necessary to define the nature of a bill of lading according to the theory and legislation. In the article the writer tries to analyze the problem about bill of lading in order to clarify that all the bills of lading is the certificate of real right and some bills of lading with certificate of real right is the certificate of ownership. |
