| 摘 要： | 精神损害赔偿向来是民法学界的一个重要的研究课题，一段时间以来我国法律对此没有明确的肯定性规定，2001年最高人民法院的司法解释第一次对精神损害赔偿作出了具体的法律规制，这是我国民法发展史上的一个里程碑。本文结合该解释，对精神损害赔偿的概念、特征、适用范围及赔偿数额等问题进行了阐释，并从司法实践出发，针对司法解释中存在的某些不足提出了一些个人的见解。

| Abstract: | Spiritual damages is always an important subject in the civil law, however,there is not definite regulation in a period of time, The judicial explanation of the Supreme People's Court make the concrete legal regulation to spiritual damages for the first time in 2001, This is a milestone in the history of our civil law development. The author analyses the concept,characteristic, scope of application of spiritual damages, proceeding from judicial practice, puts forward some personal and plain opinions to the defect in the judicial explanation. |
