| 摘 要： | 检视当下宪法学的研究成果,其方法论研究的空乏可窥见一斑.首先,学界侧重于对具体研究方法的探讨,而没有深入地研究关于方法的一般理论;其次,对方法论和具体的研究方法不加区分,在概念使用上界域模糊;再次,没有形成逻辑严密、构架科学、层次分明的方法论体系.为此,加强宪法哲学的方法论研究,明晰其研究对象、性质及功用,建构其科学体系,增强其实践理性,预见其发展走向,对澄清当下方法论研究中的困惑有着积极的指导意义.
