| 摘 要： | 过去20a我国渔业的迅速发展、社会主义市场经济体制的逐步建立以及依法治国方略的实施，迫切要求在新的渔业法中重新构造现行的渔业权制度。本文阐述了渔业权的概念和渔业权在法律上的特点和涵义以及应该遵循的原则，分析了现行渔业权制度的缺欠，并提出了一些改革建议。作者认为，必须对渔业生物资源和渔业水体实施资产化管理，依据物权法定的原则，依法明确公民和法人取得渔业权的条件，并且顺应市场经济的要求，容许渔业权依法自由、有序地流转，才能人口出生率渔业的可持续发展。

| Abstract: | Rapid development in fineries economy in the past 20 years,gradual establishment of system of the socialism market economy and enforcement of the rule of the law make it urgent to build a new and perfect system of the right of fishing and fish farming in the new Fisheries Law.The present paper deals with the concept of fisheries right and analyzes its legal features and meanings,points out the defects in the current system of the right of fisheries and gives some practical advices on how to revise the current fisheries law.In order to keep sustainable development of fisheries economy,it is held that the fisheries living resources and the fishery water body should be regarded as a special kind of property and be managed effectively,that the conditions hased on which citizens and corporation can gain the fishing right and fish farming right,must be legally definite and open to thepublic,according to the principle of the Numerus clausus,and that fisheries right,responsed positively to the requirements of gradual establishment of socialism market economy system,can be transferable legally and freely. |
