| 摘 要： | 中华民族自古崇尚整体、系统之精神,即和合精神。这一理念与现代系统观所强调的整体性、目的性与环境适应性具有相通之处,且具系统论所无法涵盖的理论空间。和合精神对现代立法具启示意义,即现代立法应该:以发展为纲,增强立法的目的性;服从全局,进行立法整体规划;强调立法互动,建立立法信息交流机制。

| Abstract: | Chinese nation has been advocating the spirit of whole and system,namely the spirit of harmony,from ancient times.The thought is similar with the ideas of wholeness,intention and environmental suitability in the modern theory of system. Furthermore,it possesses theoretical space that the theory of system cannot cover.The spirit of harmony has the enlightening meaning for modern legislation.In the modern legislative process,legislature should strengthen legislative purpose according to social development;make legislate overall plans complying with the whole situation;emphasize legislative interaction,namely establishing legislative information exchange mechanism. |
