| 摘 要： | 由于职业体育纠纷日益增多,普通的司法救济途径又不能满足职业体育领域的特殊要求.为了寻找适合职业体育纠纷解决的途径,从禁令这一典型的临时性救济措施入手,研究禁令在职业体育中的适用情况.运用文献检索法和逻辑分析法,讨论了禁令的一般性理论和禁令在职业体育中的特殊适用范围.结果表明:在国外有12种类型的职业体育案件可以颁发禁令,而我国则仅限于其中一种类型的一部分案件可以申请颁发部分禁令.

| Abstract: | Based on the method of literature retrieval and logic analysis, this paper discusses injunctions and their special scope in professional sports. Injunction, one of the temporary relief measures, is introduced because of growing professional sports disputes and the failure of the ordinary judicial relief channels to satisfy the requirements. In order to find a suitable manner for professional sports dispute resolution, the author sums up 12 types of foreign cases of which bans can be issued on professional sports, while only part of one type can be in China. |
