| 摘 要： | 驰名商标的内在价值使得驰名商标成为各国商标法保护的重点，驰名商标的认定是保护驰名商标的关键性因素，现行的行政认定模式不利于保护驰名商标权人的利益，应适当引进社会认定，为了促进公平的市场竞争环境的形成，有必要对未注册驰名商标实行跨类保护，强化对以也名商标商品装潢的特殊保护，同时在商标法中增加驰名商标的反淡化条款，以解决驰名商标与域名的冲突。

| Abstract: | The inherent value of well known trademarks makes it the focus point of Trademark Law in all countries. The key is how to determine them. The present determination is harmful in protecting the rights of the owner of well known trademarks and the appropriate social determination should be introduced. In order to build a fair competitive market, the protection of irregistered well known trademarks should go beyond one class and the special protection of their decoration should be strengthened. Meanwhile, we should introduce the antidilution clauses in Trademark Law in order to solve the conflict between well known trademarks and domain names. |
