| 摘 要： | 电子证据种类归属问题是电子证据研究的理论根基和前提。在各种学说中，“视听资料说”和“独立证据说”虽不完善却有其合理性，对电子证据种类归属的解决应当是吸纳“视听资料说”和“独立证据说”的合理部分，以电子证据吸收视听资料，合并成为诉讼法第七种证据。

| Abstract: | The categorization of electronic evidences is the basis and premise of electronic evidence study. Among the various theories, ＂audio-visual material＂ theory and ＂independent evidence＂ theory are the imperfect but reasonable ones. The solution to the categorization of electronic evidences should integrate the reasonable parts of ＂audio-visual material＂ theory and ＂independent evidence＂ theory, i.e., selecting audio-visual materials on the basis of electronic evidences, so as to develop the seventh type of evidences. |
