| 摘 要： | 近30年来，中国利用外资急剧增长，经济全球化的趋势日益突显。在这种形势下，中国政府作为东道国政府面临着两个矛盾：一是东道国利益与投资者利益的矛盾，一是国家利益与全球利益的矛盾。而这两大矛盾的焦点，都聚集于东道国政府规制。《TRIMs协议》作为第一部规范国际直接投资的全球的实体性条约，其关注的焦点也正是东道国政府规制。本文讨论中国政府在规制外资中的存在问题并提出完善我国政府规制的建议。

| Abstract: | In the last thirty years, under the circumstance of the rapid increase of the foreign direct investment and the trend of the economic globalization, the Chinese government is faced with two contradictions： the contradiction between the interest of the host country and the interest of the investors, the contradictions between the national interest and the global interest. These two contradictions tbcus on the regulations of the host countries. As the first international substantive treaty standardizing the international direct investments, TRIMs emphasize the regulations of the host countries with the greatest attention. This paper reveals the various disadvantages existing in the process and gives suggestions to improve the regulations. |
