| 摘 要： | 流质契约利弊并存,但其作为一种行之有效的担保方式,不必因其潜在的微小弊端的存在而对其一票否决废之不用。明智的选择应该是既解禁流质契约,又对其予以适当限制,以期达到既尊重当事人意思自治的私法自治精神,又适当平衡担保设定人和其他债权人以及担保权人之间利益的理想状态。 |

| Abstract: | Fluidity contract has its advantages and disadvantages,however,there is no need to deny it and prohibit it only because of the potential small defects.The wise choice is to unchain fluidity contract but place certain restrictions on it,so that it is expected to reach an ideal state in which not only the individual autonomy is respected but also the interests among the person who enact the surety,other creditors and the person who own the hypothec is properly balanced. |
