| 摘 要： | 研究了技术标准和知识产权之间的异同，技术标准与各类知识产权的关联，尤其是技术标准与专利权的关系。技术标准与专利权的关联包括有权利影响的关联和无权利影响的关联两种，有权利影响的关联是实质性关联。与知识产权产生关联的技术标准制定主要有 “知识产权推动型”、“技术标准拉动型”、“技术标准与知识产权互动结合型”三种模式。检验知识产权特别是专利是否结合进技术标准应采用专利侵权判定原则，只有对技术标准产品造成侵权的专利才算与技术标准产生了实质性关联。
