| 摘 要： | 依法行政是现代法治国家政府行使权力时所普遍奉行的基本准则,党的十五大正式提出了“依法治国,建设社会主义法治国家”的基本方略,依法行政是“依法治国”的重要内容。法优先优位于行政,法高于行政,行政必须有法,在推进依法行政的过程中,防止权力的滥用,必须健全和完善我国的行政法制监督,这是保证依法行政的一个重要环节。

| Abstract: | Administration according to the law is the basic principle, which the governments of modern countries with legal system generally pursue. The fifteenth NCCPC formally put forward the basic principle "to administer a country according to the law and build the socialist country with legal system ". Administration according to the law is one of important parts of the administering a country according to the law. The law should be prior and more superior and higher than administration in importance and law must be involved in administration. In the procession of advancing the administration according to the law, in order to prevent the misuse of authority, the supervision of administration and legal system must be strengthened and perfected, which is an important link to insure the administration according to the law. |
