劳务关系、雇佣关系、劳动关系之辨析与建构

摘    要:劳务关系、雇佣关系和劳动关系是三个相互关联而又有所区别的概念,三者之间的关系理论界和实践中都存在不同的认识和分歧.辨析三个概念之异同发现,劳务关系与雇佣关系是并列关系,雇佣关系与劳动关系是种属关系.合理建构劳务关系、雇佣关系和劳动关系之间的关系结构,不仅有利于人们从理论上清晰辨别三者之间的边界,而且有利于调整三者关系的法律制度之合理设置和运用.
