| 摘 要： | 劳务关系、雇佣关系和劳动关系是三个相互关联而又有所区别的概念,三者之间的关系理论界和实践中都存在不同的认识和分歧.辨析三个概念之异同发现,劳务关系与雇佣关系是并列关系,雇佣关系与劳动关系是种属关系.合理建构劳务关系、雇佣关系和劳动关系之间的关系结构,不仅有利于人们从理论上清晰辨别三者之间的边界,而且有利于调整三者关系的法律制度之合理设置和运用.

In academic circles and real practices, there are different perceptions of and views on the relationships among them. By analyzing the differences and similarities of these three concepts, we find that the relation between labor service relation and employment relation is parallel relation and the relation between employment relation and labor relation is subordinate relation.
